UK Gambling Act 2007 1st Sept

When it comes into full effect, the Gambling Act 2005 will repeal, amongst others, the Betting Gaming and Lotteries Act 1963, the Gaming Act 1968 and the Lotteries and Amusements Act 1976.The transitional period, when applications can be made for licences under the 2005 Act, will commence on 21st May 2007 and end on 30th July 2007. The Act is expected to come into full effect from 1st September 2007.

The city council will then become the licensing authority for premises used for most aspects of betting, bookmaking, gambling and lotteries. UK Remote Gambling
If this type of gambling is based in the UK, it is still covered by UK law, but much remote gambling is based abroad in countries where the requirements for fairness, probity and the exclusion of crime from the business may not be so stringent, if they exist at all.

However, the advertisement of such gambling opportunities are regulated by section 42 of the Gaming Act 1968, and the Gambling Commission and DCMS issued a joint note on this subject, in March 2006 – please see the useful web sites links.

UK Casinos and UK Bingo
Casinos and bingo clubs are licensed under the Gaming Act 1968 by the Magistrates’ Court. Applications for new licences for existing premises under the Gambling Act 2005 will need to be made to the city council between 21st May 2007 and 30th July 2007 in order to permit licensable activities after 1st September 2007.

UK Betting
Betting Offices and Bookmakers are licensed by the Magistrates’ Court. Pool Promoters and Track Betting are dealt with by the city council. The law is contained in the Betting Gaming and Lotteries Act 1963. Applications for new licences for existing premises under the Gambling Act 2005 will need to be made to the city council between 21st May 2007 and 30th July 2007 in order to permit licensable activities after 1st September 2007.

UK Lotteries
Not-for-profit organisations running lotteries where tickets or chances are sold over a period of time need to register with the city council under the Lotteries and Amusements Act 1976.
